Sample Resignation Letter Due to Unfair Treatment in the Workplace [2022]

When choosing to resign due to unfair treatment in the workplace, an employee should first attempt to speak with the human resources department and file a complaint against the behavior. The complaint will follow the company policies and employee handbook for dealing with conflict in the workplace. If the employee feels like the documented unfair treatment hasn’t been resolved, resigning may be the only option.

Here is what constitutes unfair treatment in the workplace:

  • The spreading of rumors about a coworker, employee, or boss.
  • Deciding to intentionally pass an employee up for a training or promotional opportunity due to their race, color, gender, sexual orientation, or other protected characteristics as defined by Title VII of the Civil Rights Act of 1964.
  • Writing offensive comments, language, emails, or other negative remarks on social media.
  • Paying lower wages to an employee of a particular race, color, or gender.

It’s important to document any unfair treatment in the workplace so it can be handled properly by an experienced state employment law attorney. If the employee decides that resignation is the best course of action, the employee can decide to resign for “personal reasons” and then come back to the employer at a later date with the employment complaint about unfair treatment.

During a resignation for unfair treatment, the employee may decide that they want to provide “no notice” or resign immediately due to the workplace's misconduct and behavior. The employee should discuss that with their manager, supervisor, or boss and inform the human resources department (through the resignation letter) of the immediate resignation.

If the resigning employee wants to resign because of “unfair treatment,” the following resignation letter can provide ample framework to position the letter.

Dear Mr. Smith —

This letter is to express my immediate resignation due to poor behavior in the workplace. Unfortunately, we have to end the positive relationship we’ve had as colleagues in this manner. Unfortunately, there have been multiple instances where I have been verbally inferred and attacked through another employee’s social media account. And I understand that there is very little control that you, as a manager and an employer, can take.

Unfortunately, due to this behavior, it is creating an uncomfortable work environment for me, and I have to decide to step away from this situation.

I sincerely apologize for any inconvenience this may have caused, and I hope we can stay connected in a professional manner for the foreseeable future.

Sincerely,
Sarah
